摘要
互联网技术的高速发展,推动了网络文学作品的迅速发展。但因为侵权成本低、维权成本高,再加上法律方面的漏洞,从美国援引来的"避风港原则"甚至成为网络服务提供商逃避责任的"免罪金牌",严重破坏了网络文学作品的著作权。因此,有必要从技术、行政、司法和立法等方面来加强对网络文学作品著作权的保护。
The rapid development of Internet technology has promoted the rapid development of network literary works.But because of the low cost of infringement,the high cost of rights protection and the loopholes in law,the “safe harbor principle” invoked from the United States has even become a “exonerated gold medal” for network service providers to evade responsibility,which seriously damages the copyright of network literary works.Therefore,it is necessary to strengthen the protection of copyright of network literary works from technical,administrative,judicial and legislative aspects.
