摘要
凡是无须禀命就可以实行诛戮者,称为专杀权,这个权力要通过授予,或者在法律允许的范围内实施。没有专杀权而擅自杀人者,则是专杀罪,不但法律有治罪条文,而且属于重罪。同样都称为专杀,前者是权力,后者是罪名,也就使专杀权与专杀罪的界限不清,进而出现许多变数。厘清专杀权与专杀罪的关系,不但可以了解古代司法的特别程序,也可以弄清法律变化的原因,以增进对中国古代法律制度的理解。
That one can execute a person without reporting to the Emperor is called the killing power. To exercise this kind of power,it must be granted,or permitted by law. Otherwise,if one kills another person without authorization,it will be the killing crime,not only with legal provisions of punishment,but also a felony. Although both are related to the killing,the former is power,and the latter is crime,which leads to ill-defined problems,and there existed many uncertainties further. To clarify the relationship between the killing power and the killing crime,one can understand not only the special procedures of ancient judicature,but also the reasons of legal change,so as to enhance the understanding of ancient Chinese legal system.
