摘要
不能以认定国家工作人员的标准来确定国企工作人员渎职犯罪的主体范围;无论是失职行为还是滥用职权行为,都应当结合决策形式(单位决策或者个人决策)进行实质的判断,切忌犯以危害结果反推危害行为的逻辑错误;应当根据企业规模和实际情况对危害结果进行理性认定,充分考虑企业经营风险等因素,坚守刑法谦抑原则,为企业发展创设宽松法治环境。
The main scope of the crime of dereliction of duty of state-owned enterprise staff cannot be determined by the criterion for identifying the state functionaries;as for whether it is dereliction of duty or abuse of power,the substantive judgment should be made in combination with the decision-making form( unit decision or individual decision),and the logical error of deducing the harmful act from the harmful result should be avoided;the harmful result should be identified rationally according to the scale and actual situation of the enterprise,taking into full consideration the business risks and other factors and adhering to the principle of modest punishment of criminal law,so as to create a relaxed legal environment for enterprise development.
