摘要
我国的环境法律在总体结构和功能上存在体系性的问题,需要借助于法律体系化的理论来将其体系化。法律体系化包括以法律原则为核心的内在价值体系构建和以法律规则为主要形态的外在规则体系构建两个维度。作为问题应对性的领域性法律,环境法律的体系化还应当符合增进环境法律的整体功能这一要求。我国的环境法律体系化应当从内在价值体系构建、完善环境法律的总体结构和增强环境法律制度的体系功能三个方面进行推进。
There exist structural and functional problems in China’s environmental laws,which need to be systematized with the help of the theory of legal systematization.Legal systematization concerns the internal systematization of legal value,which focus on the legal principles and the external systematization of legal rules.As problem oriented laws,the systematization of environmental laws should also meet the needs of promoting the overall function.According to the theory of legal systematization,the systematization of Chinese environmental laws should be promoted from three perspectives,to establish the internal value system,to improve the integral structure of environmental laws,and to enhance the systematic function of environmental legal institutions.
