摘要
公民参与公共图书馆治理,是国家治理现代化的应有之义,是公民文化权实现的重要方式。当前我国图书馆法制建设取得了长足的进步,不过就公民参与的法律保障而言仍存在着待改进的地方。揆诸欧美发达国家的图书馆法制建设经验,完善我国公民参与公共图书馆治理法治保障,需要从法理上明确公民参与是权利而不仅是政策产物,自制度建设角度强化对公民参与的立法、行政和司法保障,在实践层面着重培育公民的法治意识。
Citizen participation in the governance of public library is the proper meaning of the modernization of national governance and constitutes an important way to realize the cultural rights of citizens. China’s library legal system development has made considerable progress nowadays, however, there are still some areas such as citizen participation which need to be improved. Therefore, by appealing to the library legal construction experience of European and American developed countries, we need to improve the guarantee of citizen participation in the governance of public library, establish citizen participation is a right rather than a policy product from the legal point of view, strengthen the institutional construct of the legislative, administrative and judicial guarantees and cultivate citizens’ awareness of the rule of law at the practical level.
