摘要
环境诉讼禁令是环境司法专门化制度建构中的一项重要预防机制。目前民事诉讼制度中行为保全制度没有具体审查标准而无法保证实施效果,行政诉讼中暂时停止行政执行与先予执行制度也无法在环境行政诉讼中发挥作用,造成各地方法院环境司法专门化改革试点实践中,针对环境诉讼禁令制度所制定的审查规则以及发布的禁令文书样式不统一,预防制度功能实现和程序设置较为困难。促进环境诉讼禁令制度充分完整地发挥诉讼制度预防效果,需要合理重构与完善民事与行政诉讼相衔接的“民行一体化”环境诉讼禁令制度,并设置不同的具体审查标准和裁判文书样式规范,充分发挥环境司法专门化中诉讼禁令制度的预防功能,使这一预防性司法制度真正发挥其参与环境生态文明社会治理的公共法律服务效能与功用。
Environmental litigation injunction is a main prevention mechanism of environmental justice.In the court pilots of environmental justice specialization reform, the censorship rules and released injunction document styles according to environmental injunction system are not unified. The first reason is that the behavior preservation system in the civil procedure has no specific examination standards and cannot guarantee the implementation effect. Second, the system of temporary suspension of administrative execution and prior execution in administrative litigation cannot play a role in environmental administrative litigation. In order to fully exert the protective effect of environmental litigation injunction system, it is necessary to establish reasonable environmental litigation injunction system of "Civil and Administrative Procedure Integration" corresponding to civil and administrative litigation, and set different specific review standards and the litigation document styles. This will give full play to the prevention function of litigation injunction system in the specialization of environmental justice, and make this preventive judicial system really exert its efficiency and function in participating environmental ecological civilization society governance of public legal services.
