摘要
博物馆的数字化建设使其传统角色发生革命性改变,扩展了其在文化、历史、政治和商业方面的特色和优势,“体验经济”更是未来博物馆数字化建设的重要内容。我国博物馆的实际调查表明,博物馆在数字化建设中容易忽视和侵犯作者的精神权利,同时由于博物馆对数字化作品所有权理解偏差导致衍生作品授权困难,而博物馆官网建设中权利声明格式与内容表达混乱,不仅难以保护博物馆自身权利,也妨碍了公众对博物馆藏品的正常使用。因此,从作者精神权利与财产权利二分法、作者权利滥用以及博物馆自我定位不清三方面进行深度原因分析,并借鉴域外博物馆的合同约定、分阶段规范许可和权利声明界限划定的经验,认为我国博物馆数字化建设可以考虑转让作者精神权利,扩大合理使用范围,统一权利声明形式,防范侵权风险,以缓解当前博物馆数字化建设中的版权困境。
The digital construction of museums has revolutionized their traditional roles that has expanded their characteristics and advantages in culture,history,politics and commerce. Thus,"experience economy" is an important part of the future digital construction of museums. The survey of museums in China shows that museums tend to neglect and infringe the moral rights of authors in digitalization. At the same time,due to the misunderstanding of museum ownership of digitalized works,it is difficult to authorize derivative works. With the help of network technology,the format and content of rights declaration are confused in the construction of museum official website. Not only is it difficult to protect the rights of the museum,but also the rights of the public. Therefore,from the point of author′s moral rights and property rights dichotomy and author′s abuse of rights,as well as museum′s right consciousness and unclear self-orientation,this paper holds that the author′s spiritual rights can be transferred, expand the scope of reasonable use,unify the form of declaration of rights and prevent the risk of infringement to alleviate the current dilemma of copyright in museum digitization,by refering to with foreign museums in the contract agreement,staged standardization of licensing and rights declaration of the demarcation of rights.
