摘要
在各国难以就北方海航道的法律地位及管辖权达成共识的背景下,目前北方海航道的治理表现为,以《联合国海洋法公约》为基础,以环境保护为核心,以俄罗斯为主导的“半封闭式”治理。基于此,中国应当探索以环境保护为议题参与航道治理,这既契合《联合国海洋法公约》的基本精神,也符合各方利益诉求,更能迎合全球环境治理的需要。现阶段应搁置争议,立足《联合国海洋法公约》,重视环境保护与参与治理的表述自洽,以中俄互动促进多边机制的构建,以软法推动硬法生成,切实维护中国的航行利益。
At present, it is difficult for the relevant countries to reach a consensus on the issues of legal status and jurisdiction of the Northern Sea Route. The governance of the Northern Sea Route is based on the UNCLOS, the core issue is environmental protection, and Russia plays a dominant role. China should take advantage of environmental protection concerns to participate in the Northern Sea Route governance, which presents the basic spirit of the UNCLOS and the requirement of environmental conservation. Moreover, the countries can have consistent interests. To be specific, we should attach more importance to the suitable expressions of environmental protection to participate in the Northern Sea Route governance under the UNCLOS. We also ought to actively interact with Russia to build up multi-cooperation mechanism, and promote the real formation of the treaty by using soft law. Then our voyage interests can be effectively safeguarded.
