摘要
由于航运市场萧条,国际航运公司破产事件接踵而至。中国缺乏跨国航运企业破产处理的国际合作实践,同时相应的跨界破产立法处于空白状态,这些问题将严重制约中国的国际海事司法中心建设。针对中国司法实践在处理近期国际航运巨头韩进海运有限公司破产案中出现的困境,通过对主流国家与中国对跨界破产的域外效力以及破产程序与船舶扣押程序的冲突相关的立法和司法实践进行比较研究,提出适合中国当前经济发展环境且与国际接轨的相关立法建议,为优化中国国际航运中心软环境,改善“一带一路”法律服务环境提供帮助。
During the recent on-going depression of shipping market, bankruptcies of international shipping companies come one after another. China does not have sufficient experience in the field of cooperation handling international shipping industry’s bankruptcy, and the legislation vacancy of cross-border cooperation is another concern. This current condition will restrain the constructing of global maritime judicial center in China. As this paper’s main conclusion, The legislation proposal is drawn by discussion of issues arising from the recent case of Hanjin Shipping bankruptcy, and reviewing other major shipping economies’ legislation.
