摘要
[目的/意义]政府数据开放是提升政府治理能力,推进政府服务职能转变供给侧改革的重要途径。但数据安全和隐私问题的凸显,正成为政府数据开放的瓶颈。[方法/过程]从数据生命周期的角度,在厘清政府数据开放相关概念的基础上,建立了政府数据开放过程模型,分析了该过程各个环节存在的数据安全和隐私保护问题,然后从技术和管理相结合的视角,以数据安全治理的方法提出了若干对策建议。[结果/结论]认为政府数据开放过程中的数据安全与隐私需求多样,引发安全与隐私风险的脆弱因子复杂多变,需要从技术和管理相结合的视角完善法律体系,加强数据安全与隐私管理和技术标准规范约束,提升安全与隐私泄露风险评估和国家商用密码的应用,提高社会数据安全素养,从各方面协同对应数据安全与隐私保问题,从数据安全治理的角度解决此问题。
[Purpose/Significance] Government data opening is one of most important routes of improving the governance ability of the government and transforming the government service functions. However,the data security and privacy issues have been the bottleneck of government data opening.[Method/Process] This paper clarifies some conceptions about government data opening,and constructs a model of government data opening process in the view of data life-cycle. Furthermore,the requirements and vulnerability factors of each component in the process are analyzed,and then several relevant policy suggestions are proposed by combing technic and management.[Result/Conclusion] The author believes that both the requirements and vulnerability factors are complicated and changeable,and we need to solve the data security and privacy problems in a new synergistic way,such as by combing technic and management. It's necessary to promote the legislation system,improve the management and technical standards of data security and privacy,expend the application of risk assessment of data security and privacy,enhance the application of national mercantile cryptography,and improve the attainment among relevant individuals.
