摘要
合法性概念和理论广泛应用于社会科学各个学科领域的各类经验研究。然而,经验主义合法性理论存在着技术路径的“模糊性”与“操作化”要求之间的张力,需要在挖掘合法性的制度内涵基础上讨论合法性建构的技术路径。历史制度主义以“制度”为中心的分析视角,为“合法性建构”提供了中观层次的分析对象、合法性存续的制度解释、基础转换的动因以及正义价值的规范性意义,并拓宽其历史维度。通过这一视角的检视,可以提出“合法性类型塑成—制度变迁场域—重构边界激活”的制度分析框架,用于解释“合法性基础”与“制度变迁”之间的因果关联,从而揭示如何在制度层面构建合法性的问题。
Concepts and theories of legitimacy have been utilized widely in the study of various subjects in social sciences across all disciplines. In order to bridge the gap between the “fuzziness” of technological path and the “operationalization” of research requirements in empirical legitimacy theories, it’s necessary to discuss the technological path of legitimacy construction on the basis of excavating the institutional connotation of legitimacy. Historical institutionalism with “institution” as its center can provide the analysis object at the middle level, the institutional explanation of the existence of legitimacy, the motivation of the foundation transformation and the normative meaning of the value of justice for the “legitimacy construction”, and broaden its historical dimension. In view of this, we develop an institutional framework of “the type of legitimacy-the field of institutional change-the activation of reconstructed boundaries”, in order to examine the causal relationship between “legitimacy basis” and “institutional change”, and reveal how to construct legitimacy at the institutional level.
