摘要
外国人在华就业法律问题的研究不仅与保护外国劳动者的劳动权益息息相关,同时对我国劳动力市场的管理和发展也有十分重要的意义。随着经济全球化的进一步发展,近些年来为提高国家的创新能力并发展我国的综合国力,外国高科技人才已成为我国就业市场中急需壮大的队伍。我国当前实行的法律及政策性文件已不能适应外国人在华就业实践发展的需要,迫切需要进一步的修改和完善。在此背景下,通过运用规范分析法、文献检索法、系统分析法等研究方法对上述问题进行分析,对于其中外国就业者的非法就业问题以及与我国境内普通劳动者的权利与义务存在的区别进行探讨,为有效实现对外国就业者的劳动权益保障,同时更好地维护我国就业市场的稳定发展、构建和谐的就业关系提供初步的理论依据与路径选择。
The study of the legal problem of the employment of foreigners in China is not only closely related to the protection of the labor rights and interests of foreign workers, but also has great significance to the management and development of the labor market in China. With the further development of the economic globalization, the foreign high - tech talents have become an urgent need to grow in the employment market of our country in recent years to improve the innovation ability of the country and develop the comprehensive national strength of our country. However, the current laws and policy documents of our country have not been able to meet the needs of foreigners in the development of China's employment practice, and there is an urgent need for further modification and improvement. By using the standard analysis method, the literature search method and the system analysis method, the paper analyses the problems and discusses the differences between the illegal employment of the foreign employed persons and the rights and obligations of the ordinary workers in China so as to guarantee the effective realization of the labor rights and interests of the foreigners employed and maintain the stable development of the employment market and the harmonious employment relationship in China.
