摘要
共有产权房制度已在我国多个城市开展试点,在一定程度上解决了中低收入家庭住房难的问题。但在实际运行过程中存在法律制度缺乏、产权比例设置标准不一、适用对象准入标准难以界定、建设资金财政保障不足、监管权限不明等诸多问题。通过借鉴国外的成功经验,主要从以下几个方面提出对我国共有产权住房制度的完善建议:尽快制定共有产权房的专门立法,弥补法律空白;明晰产权比例和权利义务关系;合理界定中低收入标准,并通过定期审核的方式完善退出机制;拓宽建设资金来源渠道;设立专业化的管理运营机构,以保证运作程序的公平公正。
The system of common property rights has carried out pilot operation in a number of cities in China,which has solved the problem of housing difficulty in low-and middle-income families to a certain extent.However,in the actual operation process,there are problems such as lack of legal system,different standards for setting the proportion of property rights,difficult to define the standards for access to applicable objects,insufficient financial security of construction funds,and unclear regulatory authority.By referring to the successful experience of foreign countries,this paper puts forward suggestions on the improvement of Chinese housing system with shared property rights mainly from the following aspects:Formulate special legislation of housing with shared property rights as soon as possible to make up the legal gap,clarifying the proportion of property rights and the relationship between rights and obligations.Reasonable definition of low-and middle-income standards and improvement of exit mechanism is needed through periodic review.The sources of construction funds is widened.Establishment of specialized management and operation institutions is conducted to ensure fairness and justice in the operation process.
