摘要 人工智能算法发明带来专利保护需求,算法在人工智能发明中具有处于创新核心地位、具体化人类思维活动及应用广泛等特点。在人工智能算法发明可专利客体审查中,主要面临智力活动规则与方法、伦理道德问题、疾病诊断与治疗方法等方面的挑战。有必要对涉及人工智能算法发明的可专利性审查规则进行改进,以期适应并推动人工智能算法发明及有关产业的发展。 The invention of artificial intelligence arithmetic brings about the need of patent protection.In artificial intelligence inventions,the arithmetic has the characteristics of being at the core of innovation,concretizing human thinking activities and being widely used.In the process of patentable object examination of artificial intelligence algorithm inventions,there are mainly challenges in rules and methods for mental activities,ethical and moral examination,methods for the diagnosis or for the treatment of diseases.The corresponding patentability review rules concerning the inventions of artificial intelligence algorithms should be improved in order to adapt to and promote the development of artificial intelligence algorithm inventions and related industries.
