摘要
组织性是黑社会性质组织的根本特性,如果没有组织性的支撑,黑社会性质组织就缺乏存在的基础。严密性、稳定性和有组织性是黑社会性质组织的典型特点。对黑社会性质组织成员人数不应机械限定在10人以上,但至少也应在5人以上。"组织者、领导者"是本罪行为主体的核心,是对犯罪组织的成立、活动起关键作用的人。"骨干成员"是在黑社会性质组织中除组织者、领导者之外的对整个犯罪组织起核心作用的组织成员。"明知"要求行为人知道或应当知道该组织为黑社会性质组织。
Organization is the fundamental characteristics of the nature of the underworld organization,if there is no organizational support,the nature of the underworld organization is lack of foundation. Strictness,stability and organization are the typical characteristics of triad organizations. The number of members of the nature of the underworld organizations should not be mechanical limit to more than 10 people,but at least should be more than 5 people."Organizer and leader"is the core of the subject of this crime,which refers to the person who plays a key role in the establishment and behavior of the criminal organization."Backbone members"refer to the criminal members who play a core role in the whole criminal organization except the organizers and leaders in the triad organizations. Knowing full well that the actor knows or should know that the organization is a triad organization.
