摘要
本文对中国古代的各种法律形式、大量有代表性法律的内容和体例结构进行了比较研究 ,认为从先秦到明清 ,历朝都存在多种法律形式 ,每一种法律形式都有其特定的功能。民、刑有分 ,刑事法律与各类非刑事法律有别 ,这些立法原则古今一以贯之。律典是刑法典 ,其内容属于刑事法律的范畴 ,决非是刑事、行政、军事、民事等法律规范的诸法合编。律典与其他形式的法律 ,是分工协调、诸法并用、相辅相成的关系。无论是从各种形式的法律的内容或体例结构看 ,所谓“诸法合体、民刑不分”说都不能成立。
Through a comparative study of various forms of law and the contents and layouts of a large number of representative statutes this paper concludes that there were many forms of law in each of the dynasty from pre Qin period all the way to the Ming and Qing dynasties, with every form of law performing its specific functions. China's traditional genealogy of law clearly distinguished between civil and criminal laws and these legislative principles were consistent throughout the Chinese history. Lüdian in the Chinese law system referred to the criminal code, and not an amalgamated compilation of criminal, administrative, military and civil laws. Lüdian coordinated and complemented other forms of law, each with its own jurisdiction. In terms of contents and format of the various forms of law the argument that in the traditional Chinese genealogy of law “all laws were incorporated into one and there was no difference between civil and criminal law' does not hold water.
