摘要
被遗忘权自确立以来不断被发展,在世界上呈扩大趋势。被遗忘权的支持者认为这有利于保护个人隐私,体现了个人对社会交往的需求与希望获得重新开始的机会,是对可能出现的寡头互联网公司和强势政府的防范。然而,这些主张却遭到批评者针锋相对的强烈否定。被遗忘权面临的诸多争议说明中国目前不应当适用被遗忘权。原因在于,被遗忘权本身存在的难题无法解决,被遗忘权确立后将带来冲突和问题,具体包括与言论自由、公共利益的冲突,数据控制者自主删除信息与公权力行使的冲突,被遗忘权容易增加社会负担、迟滞科技进步与阻碍经济发展。
Since its establishment,the scope of the right to be forgotten has been expanded all over the world.The proponents of the right to be forgotten have their reasons.First,it is conducive to the protection of personal privacy.Also,it reflects the individual’s need for social interaction and hope for a chance to restart.Meanwhile,it is a guard against possible oligarchy Internet companies and strong governments.However,these claims have been strongly denied by critics.There are some reasons for China should not to adopt the right to be forgotten at present.First,there are many problems related to the right to be forgotten,which can not be resolved.Second,the conflicts between the right to be forgotten and freedom of speech and public interest should not be neglected.Third,data controllers that autonomously delete information is not always in accordance with the exercise of public power.Finally,the right to be forgotten may increase the cost of information acquisition,impede the development of information technology and hinder economic development.
