摘要
工会组织因维护劳动者权益而产生,然而在现实社会中由于各种原因,工会并不能很好地履行其维权职责,表现在:工会维权职能的弱化;工会组织的维权运行机制存在被动性特点;工会维权的实际效果有限,更倾向于维护“底线型权益”,不能很好地促进“增长型权益”。我国工会维权乏力的困境主要成因在于:经济社会的转型和当下劳资关系趋向复杂化,给工会维权工作带来了新的挑战;现行工会维权法律制度存在供给不足、刚性不够等缺陷;工会工作人员缺乏整体维权的工作思维和能力。强化我国工会的维权职能,必须从立法上明确各级工会的维权职能分工、强化工会权利的刚性约束,优化工会维权的工作模式,提高工会维权的专业性。
Trade union organizations come into being because of safeguarding workers’rights and interests.However,in the real society,for various reasons,trade unions can not fulfill their duty of safeguarding rights well,which is manifested in the weakening of the function of safeguarding rights of trade unions,the passive characteristics of the operation mechanism of safeguarding rights of trade union organizations,the limited practical effect of safeguarding rights of trade unions,and the tendency to safeguard“bottom-line rights and interests”,which can not well promote“growth-oriented equity”.The main causes of the dilemma of the weak protection of trade unions’rights in our country include that the transformation of economy and society and the complication of the current labor relations have brought new challenges to the protection of trade unions’rights;the current legal system of trade unions’rights protection has shortcomings such as insufficient supply and rigidity;and the workers of trade unions lack the working thinking and ability of the overall protection of rights.Therefore,in order to strengthen the function of safeguarding trade unions’rights in China,it is necessary to clarify the division of functions of safeguarding trade unions at all levels in legislation,strengthen the rigid restriction of trade unions’rights,optimize the working mode of safeguarding trade unions’rights,and improve the professionalism of safeguarding trade unions’rights.
