摘要
适用于发展中成员的特殊与差别待遇条款体现出世界贸易组织平衡贸易与发展的目标。但因世界贸易组织未界定发展中成员,而且多数规定表述缺乏强制性,世界贸易组织下的特殊与差别待遇的效用并未真正实现。在当前世界贸易组织改革背景下,美国、欧盟和日本等发达成员与中国、印度等发展中成员在特殊与差别待遇问题上有着较大的分歧。我国可以考虑在坚持“发展中国家”身份的基础上,承担与自身发展水平和能力相适应的义务,对特殊与差别待遇条款的适用采取灵活的态度。同时,中国应加强与其他发展中成员的合作,提升发展中成员在世界贸易组织谈判中的影响力,致力于改进相关条款的准确性、有效性和可操作性,并积极推动双边或多边的区域贸易协定谈判,通过自由贸易协定寻求更加开放、便利和规范的制度安排。
The special and differential treatment provisions applicable to developing countries reflect the goal of WTO,which is to maintain the balance between trade and development.However,since the WTO does not explicitly define what are developing countries,and most of the provisions lack enforceability,the effectiveness of special and differential treatment provisions is not fully implemented.In the context of the current WTO reform,developed members like the US,European Union,Japan and Canada,and developing members including China and India are confronted with major differences on the issue of special and differential treatment.China can consider adopting due obligation corresponding to her development level and ability based on adhering to the identity of“developing country”,and take a flexible attitude towards the application of special and differential treatment provisions.At the same time,China should strengthen cooperation with other developing countries,enhance the influence of developing countries in WTO negotiations,strive to improve the accuracy,effectiveness,and operability of relevant provisions,and actively promote bilateral or multilateral trade agreements negotiations to seek more open,convenient and standardized institutional arrangements.
