摘要
以中国知网(CNKI)1979年—2018年的数据库资料为基础,梳理关于“党内法规”的已有研究成果我们可以发现:自改革开放以来学术界对该主题的研究大体经历了起步期、推展期和深化期三个阶段;已有研究关注的焦点问题主要有七个方面:党内法规的概念,党内法规与国家法律的关系,党内法规与党的建设,党内法规与党内民主、党内监督,党内法规与党内法制、依法治党和依法执政,党内法规建设存在的问题与解决对策,党章研究;已有研究的不足主要表现在:研究视角偏狭,对其性质的研究不够,对相关主题的探讨缺乏深度,对其对于国家法治、国家治理的作用和意义的认识不足,缺乏系统性和整体性,研究论文发表期刊的层次较低。
Based on the database data of CNKI from 1979 to 2018,we can find that since the reform and opening up,the academic research on"Intra-Party Regulations"has gone through three stages:the initial stage,the promotion stage and the deepening stage.There are seven main focuses of this subject:the concept of Intra-Party Regulations,the relationship between it and national laws,Intra-Party Regulations and Party building,and inner-party democracy and inner-party supervision,and inner-party legal system,governing the party according to law and holding power according to law,problems and solutions of Intra-Party Regulations construction,and research on the Constitution of the Communist Party of China.The shortcomings of the existing studies are as follows:narrow research perspective,insufficient research on its nature,lack of depth in the discussion of relevant topics,insufficient understanding of the role and significance of Intra-Party Regulations for the rule of law and state governance,lack of systematic and integrity,and low level of publication of research papers.
