摘要
PPP项目自引进以来,在中国得到了高速的发展,但发展过程中亦暴露出较多问题。本文拟以PPP项目发展较好的国家,如美国、韩国、法国等国为例,探讨其他国家公私合作项目在央地监管模式、PPP立法、风险控制、公众参与机制等方面的表现,提出可供我国PPP项目借鉴的理念和措施,包括明确监管主体、建立健全相关法律法规、提高风险管控能力、优化风险分担机制、加强公众参与等,以期PPP项目在中国能进一步改善开拓、得到更为长足深远的发展,其投资者、消费者也均能得到更为全面的保障。
Since the introduction of PPP project, it has developed rapidly in China, but there are also many problems in the process of development. This paper discusses the performance of PPP projects in other countries, such as the United States, South Korea, France and other countries with better development of PPP projects, including the central and local regulatory model, PPP legislation, risk control, public participation mechanism, etc. It puts forward the ideas and measures that can be used for reference by China’s PPP projects, including clarifying the regulatory body, establishing and improving relevant laws and regulations, and improving risk management and control capabilities, optimizing risk sharing mechanism, strengthening public participation and so on, in order to further improve the development of PPP project in China, get more far-reaching development, and protect investors and consumers.
