摘要
海上构筑物信息系统开发、建设与应用是我国新时代“智慧海洋”建设的重要内容。布放行为的合法性首先取决于布放审批的合法性。我国的海上构筑物信息系统建设起步较晚,国内法相应的规范缺失,亟需解决的法律问题较多。极有必要借鉴发达国家的立法例和管理经验,探寻符合我国国情的法治化路径。在深刻理解全球海洋治理共识的同时,积极践行“海洋强国战略”“军民融合战略”,遵循法治思维和法治手段,构建出符合中国长远利益的海上构筑物信息系统布放审批制度。
The development,construction and application of offshore construction information system is an important part of China's construction of"Intelligent Ocean"project in the new era.The compliance of its layout is dependent on the legality of layout approval procedure.Because China's construction of offshore structures is later than other countries and lacks corresponding norms in domestic law,so there are a number of legal problems that needs to be solved.Therefore,it is necessary for us to learn from the experience of developed countries in legislation and management,and try to explore the legalization path which is in line with China's national conditions.Based on the global consensus on marine governance,China should establish the approval system for offshore structures information system layout under the strategies of marine power and civil-military integration.The approval system should be in line with China's long-term interests.
