摘要
商标先用权是《中华人民共和国商标法》于2013年第三次修改时新增加的规定,由于规定本身的抽象性,有必要对其内容进行解释。本文聚焦于商标先用权的"原使用范围",结合立法目的、比较法、典型案例、学者观点等,对"原使用范围"进行解释。"原使用范围"界定的时间点是商标注册人注册商标的申请日。范围界定要考察使用主体、商品或服务类别、商标图样、使用地域几方面,经营规模则不在考察之列,不需要对商标先用人使用该商标的经营规模进行限制。
The trademark prior right is a newly added provision to the Trademark Law in the third revision in 2013. Due to the abstract nature of the regulation itself, it is necessary to interpret its content. This paper focuses on "the original scope of use" of the trademark prior right, and combines the legislative purpose, comparative law, typical case, scholar’s point of view, etc.,to explain the term. The point of time defined in "the original scope of use" is the application date of the trademark registrant. In the definition of the scope, the user, the categoriy of the product or service, the trademark pattern and the territory of use need to be investigated, while the scale of operation is not included. There is no need to restrict the scale of operation of the trademark used by the owner of the trademark prior right.
