摘要
创新要合作,合作要分配,分配要正义,正义需问询自然法则。合作知识财产利益分配的法哲学有利于保障合作的各得其所,保障按劳动财产权理论分配权利归属、按生产要素贡献比例分配收益权。人工智能产品只是一智能程序的外在载体,不是劳动主体,其自行生成的技术或作品,权利归属人工智能技术权利人;结合形成的技术或作品,权利归属操作者与人工智能权利人共有;改进、改编形成的技术或作品,权利归属改进、改编者。合作人工智能技术及其生成技术或作品的专有权,依据劳动财产权理论和人工智能法律问题解决的前问题规则具体确定,收益权按照生产要素分配,要素贡献比例应以“市场机制+必要的宏观导向”来确定。
Innovation requires cooperation,cooperation requires distribution,distribution requires justice,and justice requires compliance with the laws of nature.The legal philosophy of benefit distribution of cooperative intellectual property could guarantee one’s share during cooperation,ensure the exlusive rights being assigned according to the theory of labor property rights,and the rights of income being distributed in terms of the production factors.The artificial intelligence product is only the external carrier of intelligent programs,not the subject of labor.Technologies or works generated by itself belong to the right holders of artificial intelligence technology,ones that formed by combining the labor of the operator are shared by operators and artificial intelligence rights holders,and those with improvements or adaptations belong to improver and adapter.The exclusive rights of cooperative artificial intelligence technology and its self-generated technologies or works shall be determined according to the theory of labor property rights and the prior problem rules for solving the problem of artificial intelligence.Their income rights are distributed according to production factors,and the contribution ratio of the factors should be determined by“market mechanism+necessary macro-orientation”.
