摘要
碳排放权交易将碳排放权作为一种商品进行交易,通过市场机制来解决温室气体减排问题。中国的碳排放权交易市场刚刚起步,要保证市场良好运行最终达到减排目的离不开完善的碳排放权交易法律制度。通过分析中国碳排放权交易的现状,针对现阶段实践中存在的问题,提出中国碳排放权交易法律制度的完善措施。提高立法层级完善配套细则,形成一套相对完善操作性强的法律体系;厘清相关概念公平初始分配,;明确主客体以及权利义务关系,完善法律架构;明确政府角色定位,保证有效监管且避免过度干预。建立符合中国国情的碳排放权交易制度,同时学习借鉴国外的经验,为将来与国际接轨做好准备。
Carbon emissions trading deals with carbon emissions permit as a commodity and solves greenhouse gas emission reduction problems through market mechanisms.China’s carbon emission trading market has just started.To ensure the good operation of the market and ultimately achieve the goal of reducing emissions,it is inseparable from the perfect carbon emission trading legal system.By analyzing the current situation of China’s carbon emissions trading,this paper proposes the improvement measures for legal systems of China’s carbon emissions trading in view of the problems existing in the current practice:to improve the legislative level and the supporting rules,to form a relatively complete and flexible legal system;to clarify the initial distribution of relevant concepts;to define the subject and object and the relationship of rights and obligations,to improve the legal structure;to clarify the role of the government,to ensure effective supervision and avoid excessive intervention and to establish a carbon emissions trading system in line with China’s national conditions,and learn from foreign experience to prepare for future international integration.
