摘要
我国宅基地使用权设置的初衷在于保障农民的基本生存条件,但是随着社会主义市场经济的高速发展,宅基地使用权的财产属性显然愈发重要。我国现行法律对于宅基地使用权没有明确的规定,但国家政策中对宅基地使用权流转的限制使得农村闲置的土地资源配置得很不合理、农民利益需求得不到满足,甚至阻碍了城乡一体化的进程。此外,从现状来看,宅基地使用权立法体系的缺失间接导致农民私下建立起了一个混乱的宅基地使用权流转地下交易市场,这个处于制度外的市场不仅损害农民利益也损害国家和集体的利益。因此,基于时代发展的要求,国家先行在试点地区尝试了宅基地使用权的自由流转。在试点地区的尝试过程中,宅基地使用权自由流转产生的新问题暴露了出来:政府主导色彩浓重、利益分配不均、农村社会保障制度跟不上等。这些都意味宅基地使用权的自由流转仍有很长的路要走。
China’s homestead use right set originally is to protect the basic housing of farmers, but with the development of the socialist market economy, property rights of homestead use is clearly increasingly important. At present, China’s law has no clear stipulation on the right to use homestead, but the restrictions on the transfer of the right to use the homestead make the rural land resources be not properly allocated, the farmers’ interests are not met, and even hindered the integration of urban and rural areas. In addition, from the current situation, the lack of homestead use rights legislation system indirectly leads to the farmers’ establishing a chaotic undergroundhomestead trading market,and the market outside the system damages not only the farmers’ interests but also the national and collective interests.Therefore, based on the requirements of the development of the times,the free transfer of homestead has been tried out in the pilot area,with new problems exposed,that is, much government involvement uneven distribution of benefits,few rural social security system. These mean that the free movement of homestead use rights still has a long way to go.
