The Foundation Participates in Running School:an Exploration of System Innovation in Non-Profit Private Colleges and Universities

摘要 民办教育新法新政背景下,实施分类管理,非营利性民办高校面临的产权归属、内部治理体制、办学资金等问题亟待解决。以基金会为办学主体的制度改革,可以实现三方面主要功能:完成学校法人的社会化转型和学校产权的公益性转化,保证非营利办学性质;将学校管理权与投资方分割,理顺内部治理架构,提高管理运作效能;培育公众信任,形成吸纳捐赠影响力,拓宽资金筹集渠道。基金会办学是非营利性民办高校制度创新的一种探索,实施中也应预估可能的问题,确立制度建设的基本原则,保证其良性运行,以达理想实效。 Under the background of new law and new policies of private education,the implementation of classified management,non-profit private colleges and universities,the ownership of property rights,internal governance system,school funds and other issues need to be resolved.The system reform with the foundation as the main body of the school can achieve the three main functions:completing the social transformation of the school legal person and the public welfare transformation of the school property rights,ensuring the non-profit running nature;dividing the school management rights and the investor,and rationalizing the internal Governance structure,improve the efficiency of management operations;foster public trust,form the influence of donation,and broaden the channels for fund raising.Turn foundations into sponsors of schools is an exploration of non-profit private college system innovation.It should also estimate possible problems in the implementation,establish the basic principles of system construction,and ensure its benign operation to achieve ideal results.
