摘要
"软暴力"行为的社会危害性在于即使没有实施暴力行为也会对被害人产生心理强制,这是因为其与暴力行为具有极强的关联性。2019年《关于办理实施"软暴力"的刑事案件若干问题的意见》细化了"软暴力"的规定,但事实上却对"软暴力"行为的认定在一定范围内进行了扩张。应将对"软暴力"行为的认定限缩在黑社会性质背景下、与普通暴力行为具有密切联系的范围内;通过体系解释,采用同类解释规则将黑社会性质犯罪中"软暴力"行为认定的危害性提升至与普通暴力相当的程度。
The harmfulness of "soft violence" is that even if no violence is carried out, it will produce psychological coercion on the victims, which is because of its strong correlation with violence. "Opinionson a Number of Issues Relating to the Handling of Criminal Cases of the Soft Violence" in 2019 makes a specific provision, but actually theidentification of "soft violence" behavior in a certain range is expanded. So the identification of "soft violence" should be limited under the background of underworld nature and closely related to ordinary violence. Through the method of systematic interpretation, adopting the same kind of interpretation rules, the harmfulness degree of "soft violence" in underworld crimes should be promoted to be equal to ordinary violence.
