摘要
费用问题是关乎商事仲裁发展的基础议题。我国仲裁收费制度历经"行政事业性收费""经营服务性收费"等不同阶段,时至今日,收费权交还仲裁机构。作为我国仲裁机构机制改革代表的北仲,自2019年9月1日起实施新的仲裁收费办法,在国内外仲裁界引发广泛关注和讨论。随着我国仲裁事业发展水平的提升、市场化竞争形势的到来,仲裁机构建立符合仲裁发展方向、契合当事人需求、体现仲裁员核心地位的收费体制将是必然选择。
Arbitration fee is a fundamental issue related to the development of commercial arbitration.China’s schedule of arbitration fee has gone through different stages,from"administrative fees"to"operating service fees".Today,arbitral institutions have regained the power to determine the arbitration fee.As a representative of China’s arbitral institution in terms of mechanism reformation,the BAC/BIAC implemented a new arbitration fee schedule in September 1,2019,causing much attention and discussion in the arbitration circles at home and abroad.With the development of arbitration system and the advent of market competition,it is necessary for arbitral institutions to establish a schedule that is in line with the goal of arbitration system development,the needs of the relevant parties and the reflection of arbitrators’core position.
