摘要
虚假诉讼罪破坏司法秩序,玷污司法纯洁,侵犯他人合法权益,其入刑是立法需要和时代要求共同催生的结果。然而,在刑法理论上,对于如何认定虚假诉讼罪之行为构造,莫衷一是,众说纷纭。《最高人民法院、最高人民检察院关于办理虚假诉讼刑事案件适用法律若干问题的解释》的出台,在一定程度上缓解了争论,但是依然没有厘清虚假诉讼罪实行行为的界线,为正确认定虚假诉讼罪埋下隐患。根据法条表述,"以捏造的事实提起民事诉讼"是虚假诉讼罪的实行行为。其中,"捏造"包括部分篡改型捏造,"事实"专指客观事实而非案件事实,并且"捏造事实"不仅限于亲自捏造事实,也包括利用他人捏造的事实。另外,对于"提起民事诉讼"应当作广义理解,包括提起民事一审程序、执行程序以及反诉,不包括提起二审程序。
The crime of false litigation undermines the judicial order,tarnishes the purity of the judicial system,and infringes on the legitimate rights and interests of others.The imprisonment is the result of both the needs of legislation and the requirements of the times.However,in the theory of criminal law,there are different opinions on how to determine the structure of the act of false litigation.The promulgation of the "Interpretation" eased the dispute to some extent,but still did not clarify the boundaries of the practice of false litigation,and laid a hidden danger for the correct identification of false litigation.According to the provisions of the law,"initiating a civil lawsuit based on fabricated facts" is an act of false litigation.Among them,"fabrication" includes some falsification-type fabrications,"facts" specifically refers to objective facts rather than case facts,and "fabricated facts" are not limited to fabrications of facts in person,but also include the fabrication of facts by others.In addition,"initiating a civil lawsuit" should be understood in a broad sense,referring to civil first-instance proceedings,enforcement procedures,and counterclaims,not including second-trial proceedings.
