摘要
跨境数据流动正成为推动新型全球化的重要特征,是新一轮国际经贸规则的焦点议题,以及大国利益博弈的战略前沿。受地缘政治、国家安全、隐私保护、产业发展水平等因素影响,主要经济体围绕“数字主权”,制定相应的数字治理模式,使全球跨境数据流动呈现有限性、灵活性、竞争性发展态势。我国应针对跨境数据流动存在的问题,以建设“数字经济强国”为发展目标,通过推进分级分类区域跨境数据流动的监管制度、构建完善的跨境数据流动管辖与信任体系、将跨境数据流动嵌入国际贸易投资协定、推动建立跨境数据流动的全球治理框架等举措,强化规则主导权,探索建立适合我国数字贸易发展及跨境数据流动的战略路径。
Cross-border data flow is becoming an important feature to promote the new type of globalization,and it is the focus of the new round of international economic and trade rules,as well as the strategic frontier of the game of great powers'interests.Influenced by factors such as geopolitics,national security,private security,and industrial development level,major economies have developed corresponding digital governance models centering on“digital sovereignty”,making the global cross-border data flow present a limited,flexible and competitive development trend.We should aim at the problems of cross-border data flows in China,to develop construction of“digital economy”,by advancing classified regional cross-border data flow regulation system,build perfect under the jurisdiction of the cross-border data flows and trust system,embed cross-border data flows to international trade and investment agreement,promote the establishment of global governance framework measures such as cross-border data flows,to strengthen the control rules,to establish suitable for China's digital trade development and the strategic path of cross-border data flows..
