摘要
数字音乐平台在数字音乐版权市场充当“分销者”时,若利用市场支配地位拒绝转授独家音乐版权,可能会排除、限制下游数字音乐传播市场竞争,进而损害终端消费者利益。反垄断法具有规制拒绝转授独家音乐版权行为的正当性基础,判定该行为是否构成违反反垄断法的拒绝交易行为,需要详细分析相关市场、市场支配地位、竞争损害及是否存在正当理由。只有在经过正负效果衡量后,才能判定该行为是否应被反垄断法禁止。
If the digital music platform owners act as the“distributor”in the digital music copyright market,the platform’s dominant position in the market is utilized by them to refuse sublicense exclusive music copyright to others,which may excludes or limits the competition in the downstream digital music communication market,thus harming the interests of the consumers.The anti-monopoly law has the legitimate basis to regulate this refusal behavior,however,it is necessary to analyze the relevant market,the market dominant power,competition damages and whether there are legitimate reasons in detail to determine whether the act constitutes a refusal to trade in violation of the anti-monopoly law.Only after the positive and negative effects are measured,can we determine whether the behavior will be prohibited by the anti-monopoly law.
