摘要
中国宅基地权利结构经历了从单一的宅基地所有权到宅基地"两权分置"再到宅基地"三权分置"的发展阶段。现行宅基地使用权制度存在问题,宅基地使用权流转普遍存在、宅基地制度改革力度不足,使得宅基地"三权分置"成为中国宅基地权利结构发展的必然结果。在坚持宅基地集体所有权的前提下,宅基地资格权和使用权的分置主要包括"成员权+用益物权"、"用益物权+用益物权"和"用益物权+债权"等三类权利构造模式。三类权利构造模式在宅基地资格权和使用权的分置基础、宅基地资格权的法律表达方式以及宅基地使用权流转制度构建等方面均存在较大争议。
The structure of homestead right in China has gone through a shift from a single homestead ownership to the separation of two rights and then to the separation of three rights. In China,the separation of three homestead rights is an inevitable result of the development of the structure of homestead right because of the problems in the current system of right to the use of homestead,the ubiquity of transfer of right to the use of homestead,and the insufficient reform of the homestead system. Under the premise of the collective ownership of homestead,the distribution of the homestead qualification right and the right to the use of homestead can be classified into three types of right,mainly including"membership + usufructuary","usufructuary + usufructuary"and"usufructuary + claim". The three types of right are controversial in terms of the separation basis of homestead qualification right and right to the use of homestead,the legal expression of homestead qualification right,and the institutional construction of transfer of right to the use of homestead.
