摘要
随着法治社会的进步,国家对财产权的保护越来越重视。我国刑事诉讼中存在大量的刑事涉案财物处置问题,特别在案件侦查阶段更容易出现侵犯公民财产权的问题。目前,我国侦查阶段使用以定罪量刑为主的证据保全代替以保障执行为主的财产保全,未能做到对刑事涉案财物的有效控制,导致刑事涉案财物保全后侦查机关因不能妥善保管而发生财产贬值现象。对此立法方面尚未明确制约侦查机关权力的监督机制,当事人财产权被侵犯后缺乏有效的救济途径。要解决上述问题,实现侦查阶段保全程序的真正价值,应当从财产保全、程序正当性等方面完善侦查阶段财产保全程序立法,建立独立统一的涉案财物保管机制与行之有效的侦查权力监督机制,为被害人设立合法有效的救济机制。
With the progress of the society ruled by law,the state pays more and more attention to the protection of property rights.There are a large number of criminal-related property disposal issues in criminal proceedings in China,especially during the investigation of the cases,it is more prone to violations of citizens’property rights.At present,evidence preservation mainly based on conviction and sentencing is used instead of property preservation mainly based on enforcement during the investigation in China,which fails to effectively control the criminal-related property,resulting in the property depreciation for investigation organs’failing to keep it properly after the criminal-related property preservation.The supervision mechanism that restricts the power of the investigative organs has not been clarified in the legislation.After the parties’property rights have been violated,there is no effective remedy.To solve the above problems and realize the true value of the preservation procedures during the investigation,the legislation of the procedures of property preservation during the investigation should be improved from the aspects of property preservation and procedural legitimacy.And an independent and unified mechanism for preservation of property involved in the case and an effective supervision mechanism for investigation power should be established to establish a legal and effective relief mechanism for victims.
