摘要
在高举证责任、证据偏在严重的现实背景下,调查核实权存在行政法律规范缺失、权力属性不明以及刚性措施缺失等问题,致使检察机关行使法律监督职责时十分依赖于行政机关的配合,这对公共利益的保护而言十分不利。随着公益诉讼不断推广和纵深化发展,调查核实权的规范与保障的重要性也日益凸显。因此,首先立法机关应当将其纳入行政诉讼法律规范以解决实践中于法无据的困境;其次,应当明确行政公益诉讼调查核实权权力属性与定位,同时并重权利性质;最后,柔性为主、刚柔并济应成为行使权力的基本原则,在保障检察机关刚性的同时避免权力失控。
Under the high realistic background of the burden of proof,and the evidence is in a serious realistic background,the problems of unclear positioning,blank legal basis,and lack of rigidity in the right of investigation and verification have caused prosecutorial organs to rely heavily on the cooperation of administrative organs when exercising their legal supervision duties.The protection of public interest is very disadvantageous.With the continuous promotion and in-depth development of public interest litigation,the importance of the standardization and protection of the right of investigation and verification has become increasingly prominent.Therefore,firstly,the legislature should incorporate it into the legal norms of administrative litigation to solve the dilemma of lack of law in practice.Secondly,it should clarify the nature and positioning of the power of investigation and verification of administrative public interest litigation,while focusing on the nature of rights.Finally,flexibility The principle of being flexible should be the basic principle of exercising power,while protecting the rigidity of the procuratorial organ while avoiding losing control of power.
