摘要
农村土地问题始终是关系我国改革发展稳定大局的根本问题,宅基地制度改革设计,是党中央、国务院部署的农村“三块地”改革试点的重要内容。农村宅基地及其上房屋统一登记,是推进宅基地制度改革、切实保障农民权益的重要基石。本文以上海为例,研究解决宅基地取得方式、主体资格、使用权面积认定,地、房一体确权等关键问题,为不动产统一登记背景下的宅基地确权登记提供参考借鉴。
Rural land issue has always been a fundamental issue related to the overall situation of China's reform,development and stability.The reform design of homestead system is an important part of the"three plots"of rural land reform pilot project deployed by the CPC central committee and the state council.The unified registration of rural homestead and its upper houses is an important cornerstone to promote the reform of homestead system and effectively protect farmers'rights and interests.Taking Shanghai as an example,this paper studies and solves the key issues such as ascertaining of the access to homestead,subject qualification,area of tenure,and rights of homestead land and houses as a whole,so as to provide reference for the confirmation and registration of homestead under the background of unified registration of real estate.
