摘要
科研自由是宪法明确规定的基本权利,国家应当采取积极措施促进科研自由的实现。我国的科研经费给付既包括普遍保障科研自由的基础性给付,也包括对某些科研活动的鼓励性给付。基础性给付的义务来源是基本权利的客观价值秩序,鼓励性给付的义务来源是宪法规定的国家任务。宪法对前者的立法要求高于后者,应当注意二者的立法形成区别。立法机关应当亲自对科研经费给付的重要问题作出规定,不得空白授权行政机关代为立法。行政机关和高校(以及科研院所)是科研经费的主要管理者,应当在程序和组织上为科研经费给付和科研权利主体提供保障。经由适当的程序和组织,确保科研经费的使用具有正当性且符合效率原则,并促进科研自由主体的权利实现。
In China,the scientific research funds include both basic payments that generally guarantee freedom of scientific research,as well as incentive payments for certain scientific research activities.Administrative organs and universities(as well as scientific institutes)are the main managers of scientific research funds,and they should provide guarantees for the payment of scientific research funds and the subject of scientific research rights by proper procedures and organizational measures,through which,to ensure that the use of scientific research funds is justified and in line with the principle of efficiency,and to promote the realization of the rights of free scientific research subjects.
