深化职务科技成果所有权、处置权与收益权配置改革路径研究 被引量:7

Research on the Reform path of deepening the allocation of ownership,disposition and income right of Duty Scientific and technological achievements

摘要 职务科技成果的所有权、处置权和收益权配置是推动科研单位科技成果转化的根本制度设计。在分析职务科技成果所有权、处置权和收益权配置关系的基础上,研究提出深化科技成果权利配置的改革路径。研究发现:混合所有制是职务科技成果所有权配置的改革路径;建立市场化、专业化的科技成果转化部门来处置科技成果或者给予科研人员实施和处置科技成果的权利是科技成果处置权的改革路径;多元主体利益共享的收益权配置方式是职务科技成果收益权配置的改革路径。 The allocation of ownership,disposition and income right of duty scientific and technological achievements is the fundamental system design to promote the transformation of scientific and technological achievements of scientific research institutions.Based on the analysis of the relationship among the ownership,disposition and income rights of the scientific and technological achievements,this paper puts forward the reform path of deepening the allocation of the rights of the scientific and technological achievements.It is found that the mixed ownership is the reform path of the allocation of the ownership of the scientific and technological achievements;Establishing mar-ketization and specialization departments to deal with scientific and technological achievements or giving scientific researchers the right to implement and dispose of scientific and technological achievements is the reform path of the right to dispose of scientific and technological achievements.The way of allocation of income right of multi-subject benefit sharing is the reform path of allocation of income right of duty science and technology achievement.
