摘要
《兵团连队职工管理办法(试行)》《新疆生产建设兵团连队职工身份地(耕地)经营权流转管理办法(试行)》和《农村土地承包法》是兵团改革和农村土地改革下先后实施的新规,对兵团职工农用地从职工身份之成员权和土地流转之财产权等方面赋予新内涵。兵团职工农用地与农村土地承包经营权在法律主体、法律客体、权利义务等方面均有所不同。要牢牢围绕维稳戍边、民兵义务和国有农用地三个方位重新界定兵团职工农用地承包经营权,增加兵团职工农用地承包权的权重以重构兵团职工农用地三权分置体系,增加融资功能以增加兵团职工农用地财产属性,同时将解除合同的权力边界划分清楚,以规范公权力保障职工私权利,促进兵团持久稳定发展。
“The Provisions of Management on Garrison Troop’s Staff”,“The Provisions of Management on the Transfer of Operation Right of Farmland for Xinjiang’s Garrison Troop’s Staff”,and“Contract Law of Rural Land”are the new regulations successively implemented with the reform of garrison troops and rural land,serving as a foundation for garrison troop’s staff in terms of land membership and right of land transfer.The garrison troopers’farmland differs from rural land in the contracting and operating right when it comes to legal subject,legal object,and rights and duties.It is argued that stability-keeping and frontier-guarding,militia’s duties,and state-owned farmland are the basis for defining the garrison troop’s staff’s contracting and operating right of farmland,that garrison troop’s staff should have more access to the contracting of farmland so as to reconstruct a division system of three rights,that financing should be expanded so as to enhance the property attribute of the contracted farmland,and that the contractual right should be clearly defined so as to ensure the staff’s private rights and facilitate the long-term development of garrison troops.
