摘要
《中国共产党章程》(以下简称党章)保障专门制度是指为维护党章的精神原则和核心内容,并保证党章得以全面有效实施所采取的法治性措施,主要包括修改限制制度、专项解释制度和审查监督制度。党章中的根本规范不能被实质性修改。党章修改提议主体、征求意见、审议和表决规则等都应严格设置。在立法论层面,党章解释专门机关确定为中央政治局更加合适,并应由党章而非其他党规进行规定。党章解释效力低于党章而高于其他党规。党章监督的对象包括党内规范和行为。党章解释不需备案审查,但也应接受党章监督。党组织和党员有权提出党章解释、审查监督的请示或建议。对党内规范的审查不能采取合党章推定,可进行合党章解释。违反党章应认定为问责条例规定的“危害较重”“危害严重”。建议适时设立党章委员会,作为党章监督机关的专门工作机构,具体承担统筹开展党章教育、研究党章修改、进行党章解释、加强党章监督等职责。
The special guarantee system of The Constitution of the Communist Party of China(hereinafter referred to as the Party Constitution)refers to the legal measures taken to safeguard the spiritual principles and core contents of the Party Constitution and to ensure the effective and comprehensive implementation of the Party Constitution,which is mainly composed of systems of restriction on amendments,special interpretation and supervision.Its fundamental norms in the must not be substantively revised.The motion of amendments,hearing,deliberation and voting rules should be strictly set.At the legislative level,the Political Bureau of the Central Committee is more appropriate to interpret the Party Constitution,which should be stipulated by the Party Constitution rather than other party regulations.The interpretation effect of the Party Constitution is lower than that of the Party Constitution and higher than other party regulations.Its objects of supervision include party norms and behaviors.The interpretation of the Party Constitution does not need to be filed for review,but it should also be supervised by the Party Constitution.Party organizations and members have the right to make requests or suggestions for interpretation,review and supervision of the Party Constitution.The review of party regulations cannot be presumed to comply with the Party Constitution,and can be interpreted in accordance with it.Violation of the“Party Constitution”should be deemed as“detrimental”and“severely detrimental”as stipulated in the accountability regulations.It is suggested that a committee be established at an appropriate time as a special supervision organization,specifically responsible for coordinating and carrying out the education,researching amendments,conducting interpretation,and strengthening supervision of the Party Constitution.
