摘要
移徙是人类维持生存和追求更高品质生活的本能。世界上没有任何地区、国家没有移徙者的身影,全球化则加剧了国际移徙态势。移徙工人数量大幅增长,极端恐怖活动猖獗,大规模的难民潮,民粹主义、保护主义等逆全球化倾向的抬头,移徙工人在就业国原本脆弱的地位,诸种因素叠加,致使当前移徙工人的人权问题异常突出。《保护所有移徙工人及其家庭成员权利国际公约》是联合国通过的保护移徙工人人权的专门性公约,但该公约所固有的局限性致使绝大部分移徙工人的人权无法籍此获得实际保护。联合国其他核心人权条约以及一般国际法的某些原则、规则和制度一定程度上可以弥补移徙工人人权保护国际标准的不足。通过国际合作,实现安全、有序、正常的国际移徙,是移徙工人人权保障的理想路径。
Migration is the instinct of human beings to maintain survival and pursue a higher quality of life.There are no regions or countries in the world without migrants.Globalization has produced much more international migration.In recent years,the number of migrant workers has increased significantly.Given that terrorism is rampant,refugee flows,antiglobalization,populism and protectionist tendencies have risen,as well as the inherently vulnerable status of migrant workers in the country of employment,the human rights issues of migrant workers have become exceptionally highlighting.The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families is a specialized convention adopted by the United Nations to protect the human rights of migrant workers,the inherent limitations of which,however,prevent the vast majority of migrant workers from enjoying their human rights effectively.In this regard,other core human rights treaties adopted by the United Nations and general principles,rules and regulations of international law can provide subsidiary international standards for the protection of human rights of migrant workers to some extent.Meanwhile,achieving a safe,orderly and normal migration through international cooperation is an ideal path to protect the human rights of migrant workers.
