摘要
我国首例涉大数据产品不正当竞争案的裁判中明晰了大数据产品的定义及特点,探究了大数据产品权益的边界,确定了大数据产品的财产性权益。但是,在该裁判中,法院没有正面回答大数据产品的法律属性及地位,仅作为反不正当竞争的财产性权益来保护,其保护程度远远不够。因此从该案的裁判思路出发,分析大数据产品的法律地位具有现实指导意义。可考量大数据产品和知识产权保护的理论和观念的相似性,参照知识产权的保护模式对大数据产权的权益作一定的限制,实现新兴权利保护。
The first case of China's big data product unfair competition case clarified the definition and characteristics of big data products,explored the boundaries of big data product rights,and determined the property rights of big data products.However,in the judgement,the court did not respond positively to the legal attributes and status of big data products,and only protected it as a property right against unfair competition,and its protection was far from sufficient.Therefore,it is of practical guiding significance to analyze the legal status of big data products from the perspective of the judgment of this case.The similarity between big data products and the theories and concepts of intellectual property protection can be considered,and the rights and interests of big data property rights can be limited referring to the intellectual property protection mode,so as to realize the emerging rights protection.
