摘要
以上海市徐汇区社区法律顾问制度为例,对公共法律服务改善城市社区治理的机制进行了分析。结果显示:公共法律服务通过社会精英的嵌入参与、法律需求的服务供给及社区矛盾的技术治理三大机制,提升了城市基层社会的治理水平。据此认为,城市社区治理应当强化法律的作用,通过社区治理法治化建设来为社区善治的实现创造条件和提供保障。
Taking the community legal counsel system of Xuhui District of Shanghai for example,this essay analyzes the mechanism of public legal service to improve urban community governance.The research shows that:The public legal service improves the level of urban grass-roots social governance through three mechanisms,namely,the embedding and participation of social elites,the service supply of legal demand and the technical governance of community conflicts.Therefore,urban community governance should strengthen the role of law and provide the premise and guarantee for the realization of good community governance through the legalization of community governance.
