摘要
在"一带一路"倡议持续推进下,高铁"走出去"并逐步发展为区域和国家间的共性交通基础设施具有一定潜力,前瞻性地对高铁关键领域国际标准和标准必要专利发展情况的适时掌握十分必要。理论上,破解标准必要专利数据来源"虚化"和"失真"问题又是开展标准必要专利量化研究的前提。本文构建了一个标准与专利关联分析的新框架,提出潜在标准必要专利(P-SEPs)概念,并选取高铁国际标准更新集中度最高的电磁兼容领域为对象,基于DII获取的558个潜在必要专利家族开展技术竞争预警分析。分析发现,高铁电磁兼容的潜在必要专利具有很强的跨学科属性,日本、加拿大、法国、韩国、德国的潜在必要专利权人平均竞争力具有显著优势,合作网络集群和跨国合作尚未形成,基于技术轨道的高铁新兴竞争领域分化凸显等,以此检验了"标准-专利"关联分析框架的适用性。最后,提出促进我国高铁技术标准与专利融合发展的政策建议。
Under the background of "One Belt One Road" Initiative, China’s high-speed rail’s "going out" and gradually developing into a common transport infrastructure between regions and countries has certain potential. It is very necessary for us to have a good grasp of the timely development of the international technical standards in the key areas and Standard Essential Patents(SEPs) of high-speed rail. In theory, to solve the problem of "virtualization" and "distortion" of the data sources of SEPs is the premise of carrying out the quantitative research of SEPs. In this paper, a new framework of association analysis between standards and patents is constructed, and the definition of Potential SEPs is proposed. The field of electromagnetic compatibility with the highest concentration of international standards of high-speed rail is selected as the object. Based on 558 Potential SEPs families obtained by DII, technology competition early warning analysis is carried out. It is found that the Potential SEPs of high-speed rail electromagnetic compatibility have a strong interdisciplinary attribute, the average competitiveness of Potential SEPs patentees in Japan, Canada, France, South Korea and Germany has significant advantages, the cooperation network cluster and transnational cooperation have not yet formed, and the differentiation of emerging high-speed rail competitive fields based on technology track is prominent, which tests the applicability of the "Standard-Patent" association analysis framework. Finally, some suggestions are put forward to promote the integration of China’s high-speed rail technical standards and patents.
