摘要
生态环境损害赔偿诉讼作为落实"最严格的生态环境保护制度"的具体体现,其与环境民事公益诉讼在诉讼请求、适用范围、诉讼目的上存在着高度同一性。"两诉"如何界分与衔接即成为学界与实务界关注且亟待解决的焦点问题。现有法律规范抑或学理研究并未充分化解"两诉"的适用冲突。对此,借助功能主义研究范式分析"两诉"背后的政治、社会等形态语境及其社会作用或许是解决二者冲突的新理路,由此界明"两诉并行"背景下的功能逻辑——"损害填补VS预防与监督",并围绕多元主体(政府机关、社会组织、检察机关)的职能定位进行有序整合与衔接。
As the embodiment of the system in the new era of implementing"the strictest ecological environment protection system",the litigation for compensation for ecological environment damage is highly identical with the environmental civil public interest litigation in litigation request,application scope and litigation purpose.How to clarify,divide and link the"two kinds of lawsuit"has become the focus of academic and practical attention and urgent need to be solved.However,the existing legal system norms or academic research have not fully resolved the conflict of"two kinds of lawsuit".To this end,it is suggested that law should be regarded as a social fact,and the functionalist research paradigm of law should be understood in combination with the political,social and other forms of context behind the birth of the law and its social role,which may be a new way to solve this problem.According to the era background of"parallel prosecution",the logical function of the two generation-"prevention and supervision+damage filling"is defined.On this basis,the functions of multiple subjects(government organs-social organizations-procuratorial organs)are integrated and connected orderly.
