摘要
分配正义是专利权益分配实践的首要伦理价值追求。无论是确定专利权属的初次分配,还是展开专利交易的再次分配,伦理正义都是其运行的本质目标。然而,专利权益分配在实践中往往不能总是依照基本伦理要求进行。专利权益初次分配与再次分配过程中一系列的伦理争议也由此诱发。而之所以在专利权益分配实践中会出现伦理偏差问题,则是由初次分配中各个相关主体之间的利益失衡和再次分配中专利权人主导下契约机制的运转失灵所造成。为实现专利权益分配的伦理正义,有必要在专利权益分配的基本伦理价值选择与原则框架的指引下展开具体的法律规则设计,以强化专利权益分配正义的伦理保障。
Distributive justice is the chief ethical value of the practice of the distribution of patent rights and interests.No matter in the initial distribution for patent ownership,or in the redistribution for patent transaction,ethical justice is the essential goal of patent system operation.However,the distribution of patent rights and interests is not always in accordance with the basic ethical requirements in practice,which arouses a series of ethical disputes in the process of initial distribution and redistribution.The reason why the ethical deviation takes place in the practice of patent rights distribution is the imbalance of interests among various related subjects in the initial distribution and the operation failure of contract mechanism that guided by patentees in the redistribution.Therefore,in order to realize the ethical justice in the distribution of patent rights and interests,it is necessary to develop the legal rules designed to strengthen the ethical guarantee of the distribution justice of patent rights and interests under the guide of the ethical value rank and principle framework of the distribution of patent rights and interests in macro level.
