摘要
随着经济社会的不断发展,我国宅基地制度相关法律法规不够完善的弊端日益显露,已无法适应当前宅基地改革的现状。通过对现行宅基地制度与推动宅基地使用权法治化的现实路径进行分析,从宅基地使用权的取得、流转和退出3个角度剖析了我国农村宅基地制度存在的问题,并提出了相应的对策。
With the continuous development of the economy and society,the defects of imperfect laws and regulations related to the homestead system in China are gradually revealed,which cannot adapt to the current situation of homestead reform.Therefore,this paper will analyze the homestead system and realistic paths to promote the legalization of the right to use homestead,analyze the problems existing in our rural homestead system from three perspectives of the acquisition,circulation and withdrawal of the right to use homestead,and propose corresponding countermeasures.
