摘要
环境法典编纂是践行生态文明思想的重要途径,生态文明思想为法典编纂提供理念支持与路径指引。环境法典是实质理性与形式理性的内在统一,并呈现出一些独有的特质。这两个理性侧面相互支持与融贯,方可"形神兼备",达致环境法典编纂的目标。在法技术构造层面,环境法典应采用适度法典化模式,采用以利益平衡为中心的调整范式"总—分"式结构框架。
The compilation of environmental code is a critical approach to carrying out the thoughts on ecological civilization,which provides the ideological support and guidelines.Environmental code is an integration of substantive rationality and formal rationality,and assumes some unique characteristics.Only by mutual support and internal coherence of two rational sides can we"achieve the intrinsic harmony",thus achieving the goal of environmental code compilation.At the level of legal technology construction,the environmental code should adopt the mode of moderate codification,an adjustment paradigm centered on the balance of interests,and the structure of"general rules-special provisions",
