摘要
由于社会经济水平的不断提高,人们对医疗卫生服务质量和医疗卫生资源数量的要求也越来越高,如何更好地满足患者的就医需求,依法保障患者的合法权益,维护医患双方的和谐关系,已成为当今社会关注的焦点问题。但是,由于我国目前尚未建立完善的医患纠纷解决机制,导致医患纠纷事件频发且在很多情况下无法得到很好地解决。如何通过制度层面的建设有效解决医患纠纷,已成为当前我国医疗卫生领域亟待解决的重要课题。文章从制度和法律的角度出发,首先分析了目前医患纠纷的现状、特点、成因及与之相关的配套制度存在的问题,其次介绍了目前国外医患纠纷制度化的治理经验,最后提出了完善医患纠纷化解机制的建议,以供医疗卫生领域借鉴。
Due to the continuous improvement of the social-economic level,people have increased demands on the quality and quantity of medical and health services and medical supplies.How to meet the health demands of patients,protect their right to receive medical care and maintain healthy relationships between patients and medical service suppliers have aroused the attention of our society/public nowadays.However,since the immature medical dispute resolution system in China,the incidents of medical care disputes frequently occur and cannot be resolved in many cases.How to effectively mediate the disputes between patients and medical service suppliers through the establishment of the effective legal prevention mechanisms has become an important issue urgently to be solved in the field of medical and health care in China.From the perspective of system and law,this article first analyzes the current status,attributes and causes of mediate the disputes of patients and medical service suppliers and flaws of the current supporting system;Secondly,we highlight the current institutionalized foreign governance experience of mediating the patients and medical service suppliers disputes;And finally the suggestions to improve the system for resolving disputes between patients and medical service suppliers have been proposed,which could be referred in the field of medical and health care.
