摘要
广义的教师人事争议包含"狭义的教师人事争议"和"教师人事处理争议"。虽然法律保护教师通过申诉寻求解决人事处理争议的权利,但实际上无论校内申诉还是校外申诉均面临法律及其实践困境。现行申诉规范中的"复核"不仅相当于校内申诉,而且应成为校外申诉的前置程序。依法解决教师人事处理争议,需要在学校章程中规范校内申诉的受理事项、受理主体、处理程序和决定效力。
The broad sense of teachers’ personnel disputes includes"teachers’ personnel disputes in the narrow sense"and"teachers’ personnel handling disputes". Although the law protects teachers’ right to seek solutions to personnel handling disputes through appeals,they are faced with legal and practical difficulties in both internal and external appeals. The"check"in the current appeals norms can not only be equivalent to an internal appeal,but should also be a pre-procedure for external appeals. In order to resolve the teachers’ personnel handling disputes in accordance with the law,it is necessary to regulate the matters of acceptance,the subject of acceptance,the procedure of processing and the effectiveness of the decision of the appeal in the school constitution.
